1. Our Commitment to Privacy EvalScribe ("we," "us," or "our") provides a mobile application designed to assist school administrators in documenting classroom observations. We understand that the data you process is sensitive. This Privacy Policy describes how we collect, use, and handle your information when you use our services.

2. The Data We Collect We collect two categories of data:

Account Information: Name, email address, school district affiliation, and payment information (processed via our third-party payment provider).

Observation Data: The text, voice recordings, and images you input into the app for the purpose of generating evaluations. We treat this data as "Transient Data."

3. How We Process "Transient Data" EvalScribe operates on a "Privacy-First" architecture.

Transient Processing: When you input Observation Data (via text, dictation, or OCR), it is transmitted securely to our cloud processors (Microsoft Azure) solely to generate the standards-aligned draft.

No Long-Term Storage: Once you confirm the completion of an evaluation and export the PDF, the raw Observation Data and the generated draft are permanently deleted from our servers. We do not maintain a historical database of your teacher evaluations.

Local Storage: The final PDF is stored locally on your device or in your personal cloud storage (e.g., iCloud, Google Drive) as directed by you.

4. Artificial Intelligence & Data Usage

No Public Model Training: We do not use your Observation Data or Account Information to train public artificial intelligence models (such as ChatGPT, Claude, or Gemini). Your data remains isolated.

Automated Decision Making: Our App provides suggestions for scoring and competency levels based on your notes. You, the human administrator, are the final decision-maker. EvalScribe does not make automated employment decisions.

5. Data Security We utilize enterprise-grade security measures provided by Microsoft Azure, including:

Encryption at Rest: Any data temporarily held during processing is encrypted (AES-256 standard).

Encryption in Transit: All data moving between your device and our servers is encrypted via TLS 1.2 or higher.

6. FERPA & Student Privacy While EvalScribe is a tool for administrators to evaluate staff, we acknowledge that classroom observations may incidentally contain student information.

School Official Exception: To the extent FERPA applies, EvalScribe acts as a "School Official" with a legitimate educational interest in providing this service.

No Student Profiles: We do not build profiles on students, nor do we sell, rent, or share any student data for marketing purposes.

7. Third-Party Sharing We do not sell your data. We only share data with trusted third-party service providers (Subprocessors) necessary to operate the App (e.g., cloud hosting via Microsoft Azure, payment processing via Stripe/Apple). All subprocessors are bound by strict confidentiality agreements.

Security and Compliance

Security & Compliance: How We Protect District Data

Architecture: EvalScribe is built on a "Transient Data" model. Unlike traditional SaaS platforms that store years of your data, we process your information only for the few minutes it takes to generate your document. Once the session ends, the data is purged from our cloud processors.

Infrastructure:

Cloud Provider: Microsoft Azure (US-based servers).

Encryption: Data is encrypted in transit (TLS 1.2+) and at rest (AES-256).

Authentication: We support standard Single Sign-On (SSO) protocols where applicable to ensure secure access.

Compliance Alignments:

FERPA (Family Educational Rights and Privacy Act): EvalScribe complies with FERPA regulations regarding the handling of education records. We function as a "School Official" under the FERPA exception.

COPPA (Children’s Online Privacy Protection Act): While our App is for adults, we comply with COPPA standards regarding any incidental collection of student data.

SOPIPA (Student Online Personal Information Protection Act): We do not use covered information for targeted advertising or profiling.

AI Safety:

Zero Training Policy: Your district's data is never used to train our public AI models. Your observations remain your intellectual property.

Human-in-the-Loop: Our system is designed to assist, not replace. The administrator retains full control over the final output.

Enterprise-Grade Security. "Privacy-First" Architecture.

We know district data is sacred. EvalScribe is built on Microsoft Azure to ensure your data is safe—and transient.

No Private Data Storage: We process your notes transiently. Once you finalize the eval, the data is cleared. We don't hold your records.
Human in the Loop: EvalScribe drafts the text, but you make the final call.
No Public Training: Your school's data is never used to train public AI models.
