EvalScribe™ Terms of Service

Our goal is to save you time and protect your data. To make that happen, we need to be on the same page regarding how EvalScribe works. These terms outline the legal agreement between you (the Administrator) and us (EvalScribe), specifically focusing on data privacy, the proper use of AI-generated content, and the security standards we maintain to keep your district safe.

1. Acceptance of Terms By downloading or using EvalScribe, you agree to these Terms. If you are using this App on behalf of a school or district, you represent that you have the authority to bind that entity to these Terms.

2. Nature of the Service EvalScribe is a drafting and productivity tool. It uses artificial intelligence to suggest text, align standards, and format documents.

You Are the Final Editor: You acknowledge that AI technology can hallucinate or generate inaccurate information. It is your sole responsibility to review, edit, and verify the accuracy of all evaluations, scores, and evidence points generated by the App before submitting them to official district systems.

3. Limitation of Liability (The "As-Is" Clause) TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." EvalScribe makes no warranties, whether express or implied, regarding the accuracy of the transcriptions, the validity of the standards mapping, or the legal defensibility of the generated evaluations.

IN NO EVENT SHALL EVALSCRIBE BE LIABLE FOR:

(A) Any employment disputes, wrongful termination claims, or union grievances arising from evaluations created using the App.

(B) Any errors in OCR transcription or voice dictation.

4. User Responsibilities You agree NOT to:

-Upload data that is illegal, harmful, or violates the privacy rights of others.

-Use the App to record conversations without the consent of all parties, where required by state law ("Two-Party Consent" states).

-Input unredacted Sensitive Personal Information (SPI) such as Social Security Numbers or student medical records into the App.

5. Ownership

Your Data: You retain full ownership of the text and PDFs you create.

Our IP: EvalScribe retains ownership of the App’s code, design, logos, and proprietary AI prompting workflows.

6. Termination We reserve the right to suspend your account if you violate these Terms or use the App to generate abusive or harassing content.

7. All elements of Apple's EULA also apply.
